TERMS AND CONDITIONS AGREEMENT

DBA LEARNING ZONE BY BMC

1. INTRODUCTION
This SMS Terms and Conditions Agreement (“Agreement”) governs participation in the text messaging program operated by BEHAVIORAL MULTIDISCIPLINARY CENTER, CORP., doing business as Learning Zone by BMC (“Company,” “Learning Zone by BMC,” “we,” “us,” or “our”).
By voluntarily opting in to receive SMS (Short Message Service) communications from the Company, you (“User,” “you,” or “your”) agree to be legally bound by the terms set forth herein.
If you do not agree to these terms, you must not opt in to receive SMS communications.
2. PROGRAM DESCRIPTION
The Company provides educational and therapeutic preschool services and may send SMS communications to parents, legal guardians, or authorized individuals who voluntarily provide their mobile number and consent.
Messages may include, but are not limited to:
Appointment confirmations
Appointment reminders (including 24-hour and same-day reminders)
Admissions follow-ups
Enrollment notifications
Program updates
Administrative service notifications
Marketing or promotional messages (only if separate marketing consent has been provided)
Message frequency varies depending on appointment scheduling, service activity, and communication preferences.
Typical frequency: 1–4 messages per appointment cycle, though additional messages may be sent as necessary for service-related communication.
3. VOLUNTARY CONSENT AND OPT-IN REQUIREMENTS
SMS communications are sent only after the User provides express written consent by selecting one or more optional consent checkboxes on the Company’s website or forms.
The Company provides two separate opt-in categories:
Marketing Messages
Non-Marketing Messages (appointment reminders, administrative updates, service communications)
Consent:
Is not required as a condition of enrollment or service
Is not pre-checked
Is entirely voluntary
May be withdrawn at any time
The Company maintains timestamped records of all consent, including the exact disclosure language presented at the time of opt-in.
4. USER REPRESENTATIONS
By opting in, you represent and warrant that:
You are the authorized subscriber or customary user of the mobile number provided;
You are at least eighteen (18) years of age;
If providing information relating to a minor, you are the minor’s parent or legal guardian;
You have the authority to consent to receive SMS communications at the number provided.
You agree to notify the Company immediately if your mobile number changes.
5. OPT-OUT PROCEDURE
You may opt out of the SMS program at any time.
To discontinue receiving messages, reply:
STOP to 321-351-3014
Upon receipt of your STOP request:
You will receive a confirmation message acknowledging your unsubscription;
No further SMS messages will be sent unless you provide new opt-in consent.
Opting out of marketing messages does not necessarily opt you out of essential non-marketing service communications unless you specifically request full SMS deactivation.

7. MESSAGE AND DATA RATES
Standard message and data rates may apply to any messages sent to you from the Company and from you to the Company.
Charges are determined by your wireless carrier. The Company is not responsible for any messaging or data charges incurred.
For information about your text or data plan, contact your wireless provider.
8. CARRIER DISCLAIMER
Wireless carriers are not liable for delayed, undelivered, misdirected, or incomplete messages.
Delivery of SMS messages is subject to effective transmission by your mobile carrier and is not guaranteed by the Company.
9. PRIVACY AND DATA PROTECTION
Your privacy is important to us.
The collection, storage, and use of your personal data — including mobile opt-in data — are governed by our Privacy Policy, available at:
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Information sharing with subcontractors in support services (such as messaging platforms or CRM providers) is permitted strictly for operational purposes.
All other use case categories exclude text messaging originator opt-in data and consent; such information will not be shared with any third parties.
The Company does not sell, rent, lease, or trade personal information.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, BEHAVIORAL MULTIDISCIPLINARY CENTER, CORP. shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages;
Delays in SMS transmission;
Errors in message delivery;
Service interruptions;
Carrier-related failures.
Participation in the SMS program is at your own risk.
11. MODIFICATION OR TERMINATION OF PROGRAM
The Company reserves the right to:
Modify, suspend, or terminate the SMS program at any time;
Update these Terms and Conditions without prior notice.
Changes will be effective upon posting to the Company’s website with a revised Effective Date.
Continued participation in the SMS program after changes constitutes acceptance of the revised terms.
12. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any disputes arising under this Agreement shall be resolved in the appropriate courts located in Florida.
13. SEVERABILITY
If any provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
14. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between you and BEHAVIORAL MULTIDISCIPLINARY CENTER, CORP. DBA LEARNING ZONE BY BMC concerning SMS communications and supersedes all prior understandings or agreements regarding the SMS program.
